3. Eligibility

4. Our Services
Fyncal provides virtual and digital financial consultancy services including:
Turnaround Audit: a one-time diagnostic analysis of financial health, profitability, risk areas, and business model assessment.
Virtual CFO: monthly ongoing strategic and financial support, including performance tracking, KPI reporting, cash flow management, and advisory input.
All deliverables may be provided via:
Secure email
Virtual meetings (Google Meets or equivalent)
Downloadable templates (Excel, PDF, PowerPoint)
The scope of each service is detailed on our website and will be confirmed via written agreement upon engagement.
5. Consultation & Onboarding
Initial consultations (free or paid) are scheduled through our website via third-party scheduling software (e.g. Calendly). You agree to provide accurate and complete information.
All clients must complete our intake form and agree to the service scope prior to the start of work.
6. Fees & Payment Terms
Fees for each package are clearly displayed on our website in GBP and USD.
Payments are processed securely via Stripe or direct invoice.
For one-time services, payment is required upfront before delivery.
For ongoing monthly services, payments are billed in advance on a recurring monthly basis.
Late Payments
We reserve the right to pause work or charge interest on overdue invoices at the statutory rate set by the UK Government.
7. Client Responsibilities
You agree to:
Provide accurate, up-to-date financial data
Cooperate with reasonable requests for information
Understand that we are not liable for incomplete or delayed work due to missing or inaccurate data
8. Advisory Limitations
Our services are advisory in nature and based on information provided by the client. While we aim to provide commercially sound financial guidance, we do not offer:
Legal advice
Tax filing or regulated accounting
Investment advice or FCA-regulated financial products
Decisions made based on our advice are ultimately the responsibility of the client.
9. Intellectual Property
All tools, templates, dashboards, frameworks, and documentation provided by Fyncal remain our intellectual property unless explicitly transferred in writing.
You may use these materials only for internal use within your business. You may not:
Resell, distribute, or publish them publicly
Claim authorship or recreate them for external use
10. Confidentiality
We take confidentiality seriously. All information shared with us by the client (financial or otherwise) will be treated as strictly confidential and will not be disclosed to third parties except:
With your express permission
If required by law or legal proceedings
11. Data Protection & GDPR
We comply with the UK General Data Protection Regulation (UK GDPR). By using our services, you consent to our collection and use of your personal and business information as described in our Privacy Policy.

12. Cancellation & Refund Policy
Turnaround Audit:
Cancellations prior to delivery may be eligible for a 50% refund if no work has commenced.
Once work has started or deliverables have been sent, refunds are not available.
Virtual CFO:
Cancellations must be made with at least 7 days' notice before the next billing cycle.
No refunds will be issued for any partial month after services have been rendered.
13. Service Availability
We aim to provide uninterrupted access to our website and services. However, we do not guarantee:
That the website or services will always be available
That errors or bugs will not occur
We may suspend or terminate services without liability if required due to legal, technical, or operational issues.
14. Termination of Services
We reserve the right to terminate services if:
You breach these terms
You act in a way that is abusive, threatening, or fraudulent
There is a conflict of interest or ethical concern
In such cases, you will be notified in writing, and no refund will be issued for unused services.

16. Liability & Disclaimer
Fyncal provides professional business advice, but we make no guarantees of financial outcomes or results.
To the fullest extent permitted by law, we shall not be liable for:
Any indirect, special, or consequential damages
Loss of profits or data
Business interruption resulting from use of our services
Our total liability will not exceed the amount paid by the client for the relevant service in the 3-month period prior to the claim.

We may update these Terms and Conditions periodically. You will be notified of significant changes. Continued use of our website or services constitutes acceptance of the updated terms.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England.
